Terms of service
The rules that apply when you rent totes, dollies, and equipment from Mad City Totes.

1. Agreement to these terms
These terms cover your rental of moving totes, dollies, and related equipment from Mad City Totes ("we", "us") in Madison, WI and the surrounding Dane County area. By reserving equipment, accepting a delivery, or using our website, you agree to them.
If you are booking on behalf of a company, building, or client, you confirm you have authority to accept these terms for them.
2. What the service is
We rent reusable plastic moving totes and optional equipment for a fixed rental period. We deliver the equipment to the address you give us, and we return to collect it at the end of the rental period.
We are an equipment rental company. We do not pack your belongings, load a truck, or move anything for you, and we are not a moving company or a storage facility.
3. Reservations, quotes, and pricing
Requests submitted through the website are reservation requests, not confirmed bookings. A rental is confirmed once we reply and agree on a delivery date and window.
Prices shown on the site are for the package and rental length described. Add-ons, extended distance outside our standard service area, and additional totes are quoted separately. Prices may change over time, but the price we confirm for your rental is the price you pay.
4. Rental period and extensions
Standard rental periods are two or four weeks, starting on the day of delivery. Your pickup date is set when the rental is confirmed.
Need more time? Tell us before your scheduled pickup and we will extend at a prorated weekly rate. Equipment kept past the agreed pickup date without notice may be billed at the weekly rate plus a return trip fee.
5. Delivery and pickup
We schedule deliveries and pickups in two-hour windows. Traffic, weather, and earlier stops can shift a window; we will contact you if that happens.
You are responsible for providing safe, legal access to the delivery point, including parking, elevator reservations, building access codes, and a clear path. If we cannot access the location during the agreed window, a return trip may be billed.
For unattended drop-offs and pickups at a location you designate, the equipment is your responsibility from the moment it is delivered until we collect it.
6. Your responsibilities
- Keep the equipment in your possession and at the addresses associated with the rental.
- Do not exceed the stated weight capacity of a tote or dolly.
- Empty every tote before pickup and stack them as delivered.
- Keep totes indoors or otherwise protected from prolonged weather exposure.
- Tell us promptly if equipment is damaged, lost, or stolen.
7. Prohibited use
Equipment may not be used to store or transport hazardous, flammable, corrosive, perishable, biological, or illegal materials, live animals, or anything that could contaminate a reusable container.
You may not sublet, sell, modify, paint, drill, or permanently label the equipment, and you may not remove it from Wisconsin without our written agreement.
8. Damage, loss, and cleaning
Ordinary wear from a normal move is expected and is on us. Totes that are cracked, crushed, burned, or otherwise unusable, and totes that are not returned, are billed at replacement cost.
Totes returned with residue, spills, paint, pet waste, smoke odor, or infestation may be billed a cleaning or replacement fee. We will tell you the amount before charging it.
9. Changes, cancellations, and refunds
Change or cancel at no charge up to 48 hours before your delivery window. Inside 48 hours we may bill a trip fee if the truck has already been routed.
If we cannot deliver as promised, you owe nothing and we will refund anything already paid for that rental.
10. Limitation of liability
We are not responsible for the contents you place in the equipment, or for damage to floors, walls, doorways, elevators, or vehicles during your use of the equipment.
To the fullest extent allowed by Wisconsin law, our total liability for any claim relating to a rental is limited to the amount you paid for that rental. We are not liable for indirect, incidental, or consequential damages, including lost time or missed move dates.
Nothing in these terms limits liability that cannot be limited by law.
11. Indemnity
You agree to cover claims, damages, and costs arising from your use of the equipment, your breach of these terms, or your violation of building rules, parking rules, or law while the equipment is in your possession.
12. Governing law
These terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Dane County, Wisconsin.
13. Changes to these terms
We may update these terms as the business changes. The version posted here on the day your rental is confirmed is the version that applies to that rental.
